Do You Need Planning Permission for a Granny Flat in Ireland?

The short answer: it depends on the size, location and intended use. In Ireland, a granny flat or garden annex may be exempt from planning permission if it meets specific exemption criteria under the Planning and Development Regulations. However, the rules are nuanced, and getting it wrong can be costly.

When Is a Granny Flat Exempt from Planning Permission?

Under Irish planning law, a garden structure may be exempt from planning permission if ALL of the following conditions are met:

  • Floor area: The structure does not exceed 25m² of internal floor space.
  • Height: The roof height does not exceed 3 metres (flat roof) or 4 metres (pitched roof).
  • Setback: The structure is at least 2 metres from any boundary.
  • Ancillary use: The structure is for use incidental to the enjoyment of the main dwelling (e.g., a home office, gym, or occasional guest accommodation).
  • No separate dwelling: The structure is not self-contained as a separate residential dwelling (no independent living facilities that would constitute a separate unit).

If your planned granny flat meets all of these, you likely don't need planning permission. However, we always recommend confirming with your local authority during a free site survey.

When Does a Granny Flat Need Planning Permission?

You will need to apply for planning permission if:

  • The floor area exceeds 25m².
  • The structure is within 2 metres of a boundary and exceeds 2.5m in height.
  • You intend to use it as a separate, self-contained dwelling (with its own kitchen, bathroom and sleeping area for independent living).
  • The structure is in the front garden or visible from the public road.
  • Your property is a protected structure or in a conservation area.
  • You plan to rent it out as a separate residential unit (this is a common pitfall — renting a granny flat as a separate dwelling changes its legal status).

The "Separate Dwelling" Trap

This is the most misunderstood aspect of granny flat planning in Ireland. A 25m² garden room used as a home office is likely exempt. That same 25m² structure, fitted with a full kitchen and bathroom and rented to a tenant, may require planning permission because it's now functioning as a separate dwelling.

If you want a granny flat for a family member (e.g., an elderly parent), the key question is whether it's genuinely ancillary to the main house or operates as an independent unit. This is where professional advice matters — and where our team can guide you.

Modular Granny Flats: The Smart Choice

Modular construction is ideal for granny flats because:

  • Speed: Built in weeks, installed in days — minimal disruption for your family.
  • Quality: Factory-built to A-rated energy standards.
  • Flexibility: Can be reconfigured or relocated if needs change.
  • Cost certainty: Fixed-price contracts with no overruns.

Our Chapter Two range is particularly popular for granny flat use — a 38m² pod with open-plan kitchen, bedroom and wet-room. For larger annexes, our Chapter Three range offers full customisation.

The Planning Application Process (If You Need It)

If your granny flat does require planning permission:

  1. Engage a professional: We can help with drawings and specifications.
  2. Submit to your local authority: Application fee is €65.
  3. Wait: Typical decision time is 8–12 weeks.
  4. Appeals: If refused, you can appeal to An Bord Pleanála within 4 weeks.
