Do Modular Homes Need Planning Permission in Ireland?

Yes and no. A modular home in Ireland needs planning permission if it's a separate, self-contained dwelling. But many of our smaller units — garden rooms, garden offices and annexes up to 25m² — fall under exempted development and need no planning application at all.

The confusion around this question is understandable, because "modular home" is used to describe everything from a garden office to a four-bedroom family house. The planning system doesn't care how the building was made — factory or site — it cares what it is and how it's used. A self-contained dwelling needs planning; an ancillary garden building within the limits may not.

What Is Exempted Development?

Ireland's Planning and Development Regulations allow certain structures to be built without planning permission. For a garden building to be exempt it generally must:

  • Be ancillary to the main dwelling (not a separate home).
  • Have a floor area up to 25m².
  • Sit behind the rear building line of the house.
  • Stay below the height limit (typically 4m for a pitched roof).
  • Keep the required setback from boundaries.

Our Chapter Two garden studio and Garden Rooms often qualify for this exemption.

A few details that catch people out: the 25m² is cumulative across all garden buildings on the property, not per building. The rear building line is the rear wall of the house as originally built, not as extended. And the exemption is for ancillary use only — a garden room you rent out as a self-contained unit is no longer exempt, even if it's under 25m².

When Does a Modular Home Need Full Planning?

You need full planning permission when the modular home is:

  • A primary, self-contained dwelling (separate kitchen, bathroom, living and sleeping).
  • Larger than the exempted threshold.
  • Rented out or sold independently of the main house.
  • On a protected structure site or in a special amenity area.

Our bespoke family homes and any unit intended as a main residence require full planning.

What Is the 2026 Class 3A Modular Exemption?

Recent updates to the regulations have introduced a Class 3A exemption specifically for modular-type homes under certain conditions, making it easier than ever to build a modest modular home without a full application. We stay current on these rules and will advise whether your project qualifies.

Planning rules in Ireland do evolve, and the direction of travel has been towards encouraging more, faster housing delivery — which has generally made things easier for modular builds. That said, the details matter, and an exemption you read about online may have conditions that don't fit your site. We treat planning advice as specific to your circumstances, not generic.

How Long Does Planning Permission Take in Ireland?

The standard statutory decision period is eight weeks from a valid application, though complex applications or requests for further information can extend this. We build the planning timeline into your project plan from the outset so there are no surprises. For exempt builds, there's no planning wait at all.

Can New Chapter Homes Handle My Planning Application?

Yes. We're experienced with planning authorities across Ireland and can prepare and submit the full application on your behalf — drawings, site notices, fees and follow-up. Or, if your build is exempt, we'll confirm that in writing.

How Do I Know If My Build Is Exempt?

The only way to be sure is a professional assessment. Use our Planning Guide, or book a free consultation and we'll tell you definitively whether your modular home needs planning permission in Ireland.
