Compliance Is Not Optional

The new exempted development regulations allow homeowners to build a modular home in their back garden without planning permission — but the regulations are explicit that all Building Regulations and Building Control requirements must still be met.

At New Chapter Homes, we welcome this. We have always built to the highest regulatory standards, and we believe that every modular home in Ireland — whether in a back garden or on a greenfield site — should be safe, energy-efficient, and fully fitted.

Our Compliance Process

Here is exactly what happens when you build a New Chapter modular home:

1. Structural Engineering

Every unit is structurally designed by qualified engineers. Our modular homes are built to withstand Irish wind and weather conditions, with foundations appropriate to your specific ground conditions. We don't use off-the-shelf designs — every project is engineered for its location.

2. Fire Safety Certification

Our homes meet Part B (Fire Safety) of the Building Regulations. This includes:

  • Fire-resistant construction between dwellings
  • Adequate means of escape routes
  • Mains-connected smoke and heat detectors
  • Fire-rated doors where required

3. NZEB Energy Compliance

All our homes meet the Nearly Zero Energy Building (NZEB) standard, achieving a BER rating of A2 or better. This means:

  • High-performance insulation in walls, roof, and floor
  • Airtight construction to minimise heat loss
  • Energy-efficient windows and doors
  • Renewable energy systems (heat pump, solar thermal, or equivalent)
  • A minimum 20% renewable energy ratio

4. Ventilation and Air Quality

We design proper ventilation systems in compliance with Part F, ensuring healthy indoor air quality. Depending on the project, this may include mechanical ventilation with heat recovery (MVHR) or natural ventilation with background ventilators and extract fans.

5. Electrical and Plumbing Certification

All electrical work is carried out and certified by Safe Electric registered contractors. All plumbing and drainage work meets Part H requirements for sanitary and drainage conventions.

6. BCAR Certification

For projects that fall under BCAR, we work with Assigned Certifiers and Design Certifiers to ensure the full building control process is followed:

  • Commencement Notice filed with the local authority
  • Inspections at key construction stages
  • Certificates of Compliance on completion

Documentation You Receive

When your New Chapter home is complete, you receive a full compliance pack including:

  • Structural engineer's certification
  • Fire safety compliance documentation
  • BER certificate (A2 or better)
  • Electrical completion certificate (RECI/Safe Electric)
  • Plumbing and drainage compliance documentation
  • BCAR completion certificates (where applicable)

Why This Matters

With the new planning exemptions, the market will see an influx of modular home providers — not all of whom will meet the same standards. Some may offer cheaper units that cut corners on insulation, fire safety, or structural integrity.

We urge every homeowner to ask their provider: "Can you provide full Building Regulations compliance documentation?" If the answer is anything less than a clear yes — with certificates to back it up — walk away.

At New Chapter Homes, the answer is always yes.

Note: The planning exemptions referenced here are in force from 27 July 2026 under S.I. No. 340 of 2026. Building Regulations apply regardless of planning status. Always verify the current position with your local authority before proceeding. See our Planning Permission Ireland: The Complete 2026 Guide for the latest information.
