The Short Answer
In most cases, no — a garden room in Ireland can be built without planning permission under the exempted development rules. But the exemption has strict limits, and stepping outside them means a planning application, delays, and possible enforcement.
The Exemption Rules (2026)
A garden room is generally exempt if all of the following are true:
- Floor area: no more than 30m² (extended to 40m² in some cases for rear-of-house extensions, but standalone garden rooms stick to 30m²).
- Height: 2.4m where it adjoins a boundary wall; up to 3m elsewhere; and no more than 4m for a pitched roof.
- Location: behind the rear wall of the house, not in the front garden.
- Use: incidental to the enjoyment of the house — a home office, studio, or guest room is fine; running a business with regular visiting clients may not be.
- Protected structures: if your house is a protected structure or in an architectural conservation area, different rules apply — always check.
When You WILL Need Permission
- Anything over 30m² as a standalone unit.
- A garden room you intend to let separately or use as a self-contained dwelling.
- A tall design close to a boundary.
- Anything in the front garden or ahead of the house.
